VESSEL TOWING AND PRIVATE PROPERTY IMPOUND CONTRACT

This contract made and entered into this _____ day of ___________ 2012 by Neptune Towing & Recovery, Inc and Between__________________________________of the city _________________________, Pinellas County, State of Florida

Party of the first part, and Neptune Towing & Recovery of St. Petersburg, Florida, county of Pinellas, State of

Florida, party of the second part.

WHEREAS, ___________________________________________________________________, as the owner, lessor or authorized agent or the owner or lessor of the above described property decides to utilize the services of Neptune Towing & Recovery, Inc. as authorized by the Statute of the State of Florida.

WHEREAS, Neptune Towing & Recovery, Inc. is duly authorized and licensed by the laws of the State of Florida and the local government authorities to perform said towing services.

NOW, THEREFORE, in accordance with the foregoing premises it is hereby mutually agreed as follows:

That Neptune Towing & Recovery, Inc. will tow away all unauthorized or illegally parked vessels from the above posted property (TOW AWAY ZONE) at the vessel owner’s expense.

Towaways can be done at any time and on any day of the week; however, the stowaways will be correlated with a designated contract. The stowaways will be conducted primarily - but not exclusively- for security reasons and also for the elimination of trespassing, littering, loitering, and nuisance. The correlation of stowaways can be done before or after the tow.

Neptune Towing & Recovery, Inc. has posted or will post the required TOW AWAY signs. All towed vessels are subject to enforcement pursuant with State of Florida Law. If vessel is not redeemed from impound by payment as allowed by law and remains unclaimed, the said vessel may be sold at public auction free of all prior liens.

This contract runs for 1 year from this date and will automatically be renewed year by year for subsequent years- unless written cancellation is given thirty (30) days prior to its expiration. Contract will automatically void if ownership or management change.

That Neptune Towing & Recovery will tow any vessels, witch are parked at fuel docks, illegally docked or anchored, blocking other vessels on the waterway, front of entrances to marinas, non-designated slips and or avoiding legal docking fees, rules and regulations.

Derelict and sunken vessels will be towed by special arrangement and the property owner will be liable for the salvage & disposal cost. This includes any pre-existing derelict or sunken vessels on or near your property.

IN WITNESS THEREOF, the above named parties have hereunto set their hands and seals on the day above written, and for themselves, their heirs, administrators, and assigns, do hereby agree to do the full performance of the covenants and agreements as herein above set forth.

Tow Away signs are required by Florida Law for any commercial account. Minimum 5 signs / $45.00 each.
